Nighttime Police Visit or Search: How to Behave and Whom to Call Urgently

The appearance of the police at the door of an apartment or office in Poland early in the morning or late at night is a highly stressful situation. The suddenness, knocking on the door, uniforms, and serious faces of the officers often paralyze a person’s ability to act. Meanwhile, the first hours and even minutes of communication with law enforcement determine not only the outcome of a particular investigative action, but also the fate of the criminal case as a whole.

In Polish reality, procedural rules (Kodeks postępowania karnego — KPK) clearly regulate the rights and obligations of both law enforcement officers and the persons they come to. Knowledge of these rules, a cool head, and a timely call to a lawyer are your main protection.

Basic Safety Rules: Should You Open the Door?

The main rule in the first seconds: do not panic and do not open the door automatically.

  • Police officers or officers of the Central Anti-Corruption Bureau (CBA) are required, through the closed door or through the peephole, to show their service IDs (legitymacja służbowa) and state the reason for their visit.
  • According to Article 221 of the Polish Code of Criminal Procedure (KPK), a search of residential premises may not be conducted at night (i.e. from 22:00 to 6:00), except in cases where delay is not possible (przypadek niecierpiący zwłoki), or if the search began during the day and continues, as well as in cases involving crimes related to drugs, weapons, or human trafficking (provided that the relevant authorization is in place). If officers are breaking down your door at night without authorization from a prosecutor or court and without emergency grounds — this is a violation of the law.
  • Regardless of the time of day, law enforcement officers must provide an order from a prosecutor or court authorizing the search (przeszukanie) or detention. Carefully examine the document:
  • Is your address indicated?
  • Who is the person involved in the case?
  • What exactly are they looking for (what items, data carriers, documents)?
  • Is the document signed by an authorized person?

Typical Scenarios: Apartment vs. Office

Investigative actions conducted in residential premises and in a commercial office have their own specifics.

Scenario A: Search of an Apartment

Family members, children, and pets may be at home. The police act firmly in order to demoralize the occupants.
• You may be asked to remain in one room, prohibited from using phones, or prevented from moving around the apartment without an officer accompanying you.
• The police have the right to conduct a superficial search of you and your belongings if there is suspicion that you are concealing prohibited items.

Scenario B: Search of a Company Office

• The first thing law enforcement officers do in an office is block the entrance doors, confiscate employees’ mobile phones, prohibit any contact with the outside world, and restrict access to computers.
• Particular attention is paid to servers, cloud storage, accounting records, and the workplaces of top management.
• By law, during a search of an office, a company representative (owner, director) or a person authorized to represent the company’s interests should be present.

Whom and When to Call Urgently?

Your absolute right in Poland is the right to defense (prawo do obrony). You are not required to give testimony without the presence of a lawyer.

Lawyer (Adwokat / Obrońca)

Immediately demand the opportunity to contact your lawyer. If you do not have a regular lawyer, keep the number of an on-call lawyer from a professional association or a specialized law firm in your phone contacts.

Emergency Call

By law, you may not be denied one phone call to notify your defense lawyer or relatives about your detention/search. Make this call immediately.

Consul (for Foreigners)

If you are not a Polish citizen, you have the right to request that the consulate of your country be notified of your detention or investigative actions concerning you.

Important: Do not wait until the search is over to call a lawyer. Call within the first few minutes, as soon as you have confirmed that the people behind the door really are police officers. The lawyer should immediately come to the scene.

Documenting Violations by Law Enforcement Officers

Unfortunately, procedural violations often occur during searches. Your task is to document them as thoroughly as possible for subsequent appeal to the court (zażalenie na przeszukanie).

• Under Polish law, independent persons (świadkowie / osoby przybrane) should be present during a search, although in practice the police often try to conduct procedural actions without them, citing the urgency of the situation. Demand that independent witnesses be brought in.
• If the warrant states that they are looking for documents concerning a specific contract from 2024, but the police start downloading all personal photos from your phone or confiscating equipment unrelated to the case — this is a direct violation.
• Document any manifestations of rudeness, intimidation, or denial of the right to make a phone call.
• At the end of the search, a detailed report (protokół przeszukania) is prepared. Never sign it without looking at it! Be sure to enter all documented violations in the comments section (uwagi): “The search was conducted without witnesses,” “The lawyer was not allowed to participate,” “Items not specified in the order were confiscated.” If you were refused the opportunity to enter comments, make a note of this.

  • The Role of the On-Call Lawyer at the Scene
    The lawyer who arrives at the scene performs several critically important functions:
  • The lawyer checks the officers’ authority, the correctness of the order, and the legality of every step taken by law enforcement.
  • Under the guise of a “friendly conversation” at the scene of the search, police officers often attempt to obtain confessions or force people to sign documents. The lawyer blocks any attempts at an unofficial interrogation.
  • The specialist ensures that the copying of hard drives and smartphones is carried out in strict accordance with the cybersecurity rules of the company or private individual, preventing the leakage of trade secrets.
  • The lawyer helps properly prepare the search report and promptly files a complaint with the district court against unlawful actions by the police or prosecutor’s office.

  1. Stay calm and do not panic.
